Please read these Terms of Service ("Terms", "ToS") carefully before using the website or services operated by RKling Associates, Inc. dba York Landscaping and Irrigation ("Us", "We", or "Our").

1. Acceptance of Terms

By requesting a quote, signing a service agreement, or accessing our website, you agree to be bound by these Terms. If you disagree with any part of the terms, you may not access the service.

2. Services and Estimates

  • Scope of Work: Services will be performed as described in the written estimate provided via our CRM, Service Autopilot.

  • Estimates: Estimates are valid for thirty (30) days. We reserve the right to adjust pricing if the property conditions have changed significantly since the initial walkthrough.

3. Client Responsibilities & Property Access

  • Access: The Client grants York Landscaping and Irrigation permission to access the property on scheduled service days. Please ensure gates are unlocked and pets are secured indoors.

  • Obstructions: Please keep the work area clear of toys, tools, and pet waste. We are not responsible for damage to items left in the work area.

  • Utilities: It is the Client's responsibility to inform us of any private underground lines (e.g., invisible fences, private lighting). We are not liable for damage to unmarked private lines.

4. Billing and Payment

  • Portals: Payments are managed through our secure Service Autopilot portal.

  • Terms: Payment is due upon receipt of the invoice unless otherwise stated.

  • Card on File: For recurring maintenance, we may require a credit card on file. You authorize us to charge the card automatically upon completion of service.

  • Late Fees: Invoices unpaid after 30 days may be subject to a late fee of 1.5% per month.

5. Cancellations and Changes

  • Notice Required: Please provide at least 48 hours notice for cancellations.

  • Trip Charges: If our crew cannot access the property (locked gates, etc.), a trip charge may be applied.

6. SMS and Mobile Communication

By providing your phone number, you agree to receive service-related and promotional text messages (reminders, "on our way" notices, quotes, and billing alerts) from York Landscaping and Irrigation.

  • Consent: Consent to receive automated marketing text messages is not a condition of any purchase.

  • Frequency: Message frequency varies.

  • Rates: Message and data rates may apply.

  • Opt-Out: You may reply STOP to any text message at any time to unsubscribe from SMS communications.

  • Support: Reply HELP for help or contact us at [email protected].

7. Call Recording and Monitoring

By calling York Landscaping and Irrigation, you acknowledge and agree that your telephone calls may be recorded or monitored for quality assurance and training purposes via CallRail.

8. Limitation of Liability

To the maximum extent permitted by law, RKling Associates, Inc. shall not be liable for any indirect, incidental, or consequential damages resulting from the use of our services.

9. Governing Law

These Terms shall be governed and construed in accordance with the laws of the State of Texas.
